How do I ensure the Court can enforce my subpoena to a witness?

The Court can ONLY enforce a Subpoena, and compel the person to attend court WHEN the subpoena is properly served AND either the party files a timely return of service with the clerk of court.

Timely filing the proof of service requires that it be filed with the clerk AT LEAST 24 hours prior to the court date and time and notice has been given to the opposing party.

Parties subpoenaing witnesses have a duty to send a copy of this return of service of subpoena to the opposing party.
