Policy Statement

It is the policy and practice of Gallatin County to comply with the Americans with Disabilities Act (ADA), the amendments thereto, and applicable state law prohibiting discrimination on the basis of disability. Gallatin County is committed to providing equal access and opportunities to qualified job applicants and employees with disabilities, and to prohibiting discrimination on the basis of disability in the application process and the employment relationship.

ADA Coordinator

The County Administrator is the designated ADA Coordinator. All inquiries and complaints should be made to the ADA Coordinator, as follows:

Title II, Public Services

Title II prohibits a public entity from excluding from participation in or denying the benefits of the services, programs, or activities of the public entity to any qualified individual with a disability. A public entity also may not subject such individuals to discrimination. The protections of Title I apply to Title II and to employment in any service, program, or activity conducted by a public entity.

Gallatin County has adopted the Gallatin County Section 504 and ADA Complaint Resolution Procedures and the ADA Complaint Form to provide the notices required by federal law and to resolve complaints alleging a violation of Title II. (Gallatin Co. Res. No. 2010-029 (Mar.16, 2010)). The complaint process is discussed below at Section 112.80 (“Complaint Resolution”).

Complaint Resolution

Any individual who believes that he or she has been subjected to unlawful discrimination on the basis of a disability may, by himself or herself or by an authorized representative, file a written complaint.

Complaints must be in writing and directed to the ADA Coordinator.  Complaints should be made on the ADA Complaint Form, which is available by contacting the ADA Coordinator, and contain the following information:

  1. The name, address, and telephone number of the individual or representative filing the complaint;
  2. The date and location of the alleged discriminatory action;
  3. If filed on behalf of a third party, the identity of the alleged victims of the discrimination;
  4. The persons involved in and any witnesses to the alleged discriminatory action;
  5. A description of the alleged discriminatory action;
  6. A description of the corrective action sought; and
  7. The signature of the complainant or authorized representative.

The complaint must be received within 30 calendar days from the date of the alleged discriminatory action. This time may be extended as determined by the ADA Coordinator for good cause shown.

Gallatin County will promptly conduct an informal investigation of the complaint. Interested parties will be afforded an opportunity to submit relevant information. Gallatin County will issue a written response to the complaint and forward a copy to the complainant no later than 30 calendar days after completion of its investigation.

An individual also may pursue other remedies as allowed by law, including filing a formal complaint with the Montana Human Rights Bureau, with any federal agency the individual believes is appropriate, or with the U.S. Department of Justice for referral. The time limit for filing a formal complaint is 180 days from the date of the alleged discrimination.
