Filing a Domestic Relations Case (Divorce, Parenting Plan, etc.)

Dissolution of marriage actions and parenting actions are filed in the Clerk of District Court’s Office.  If you wish to handle a dissolution or parenting matter pro se (without an attorney), you can obtain forms at no cost from the following sites:  courts.mt.gov, montanalawhelp.org, or you may visit the Self Help Law Center located in the basement lobby of the Law and Justice Center, 615 South 16th Avenue, Bozeman, Montana.

Cost of Filing

The cost to file a dissolution of marriage action is $250.00 ($200.00 filing fee and $50.00 judgment fee).  We accept cash, credit or debit card, or check or money order payable to “Clerk of District Court.”  If you are unable to pay the required fees, you can submit a Statement of Inability to Pay Court Costs and Fees.  This form is available in the Clerk of District Court’s Office.  The fee waiver must accompany your opening documents and must be approved by a District Court Judge prior to us filing your petition.

Gallatin County Child Support

Please note that MOST child support collections are not received by the Gallatin County District Court. Please contact the Child Support Services Division (CSSD) at https://dphhs.mt.gov/cssd/ or by calling 1-800-346-5437 for assistance.

If you are filing a Dissolution Action (Divorce) with minor children, please note that the Gallatin County District Court requires a Child Support Guidelines Worksheet to be included with your filing, regardless of requested child support.
